Representing a Client with Diminished Capacity

This session will cover some of the legal rules applicable to attorneys working withclients who experience diminished capacity and the consequent potential for fraud and abuseagainst a client with diminished capacity. Attendees will learn how to:
• Identify a client who has diminished capacity and the appropriate steps to taketo assure continuity in managing the client’s portfolio
• Document a client’s file with the appropriate legal documents to anticipatediminished capacity protocols and practices the advisor can use to protect him/herself
