With the stroke of a pen on a grand jury indictment, the Enron Task Force destroyed Arthur Andersen LLP and its 85,000 jobs world-wide--only to be reversed three years later by a unanimous Supreme Court because Andersen's conduct was not criminal and the prosecutors had persuaded the judge to take criminal intent out of the jury instructions. They then turned their sights to Merrill Lynch and sent four Merrill Lynch executives to prison on an indictment that criminalized innocent business conduct while they hid the evidence that showed the defendants were innocent.
