Lloyd A. Bookman is co-chair of the firm's regulatory department. Since 1979, his practice has involved exclusively the representation of health care providers in a wide variety of reimbursement, regulatory and transactional matters. In 1987, Mr. Bookman, together with Patric Hooper and Robert W. Lundy, formed the national health care law firm of Hooper, Lundy & Bookman. As a Founding Partner, he continues to specialize in the representation of health care providers in complex matters.
Mr. Bookman is a nationally recognized expert on Medicare and Medicaid reimbursement and has served as lead counsel in highly significant cases, including Orthopaedic Hospital v. Belshe, in which the Ninth Circuit ruled that Medicaid hospital outpatient rates must bear a reasonable relationship to costs, and which ultimately led to a $350 million retroactive payment to California hospitals. He was also lead counsel in Alvarado Community Hospital v. Shalala and County of Los Angeles v. Shalala, in which the Ninth and D.C. Circuits held that Medicare outlier payments under PPS were unlawfully set in cases involving 300 hospitals. He continues to successfully represent hospitals and other health care providers in major litigation challenging Medicaid rate reductions. He regularly represents providers before the Provider Reimbursement Review Board, state Medicaid agencies, and in federal and state courts in reimbursement disputes.
Most recently, in connection with state Medicaid financing legislation and regulations, Mr. Bookman negotiated and drafted complex Medicaid provider fee legislation in California, which brought approximately $3 billion in federal funds into California.
Regarding compliance matters, Mr. Bookman advises clients concerning billing and cost report issues, false claims, anti-kickback and self-referral matters, self-disclosures to the OIG and other governmental entities, and development of compliance plans. Additionally, he serves as counsel in civil and administrative litigation and investigations, and as special counsel in criminal matters, and is also a member of the firm's Fraud & Abuse Practice Group.
Mr. Bookman also represents and advises clients in a wide range of transactional matters, including sales and acquisitions, affiliations, network and integrated delivery system formation, joint ventures and other syndications, accountable care organization development, and physician contracting.
As an expert witness on reimbursement issues, Mr. Bookman has testified in court and before state agencies. He is a frequent speaker on health care matters at conferences and educational venues.
Mr. Bookman has received numerous awards and honors, including a Distinguished Achievement Award from the California Hospital Association, and the prestigious Mathies Award for Health Care Leadership from Partners in Care. He is regularly recognized by such publications as Super Lawyers and Chambers USA as one of the premier health care lawyers in the United States, and was named as one of the “Top 100 Lawyers in California” by the Daily Journal in 2010.
Mr. Bookman graduated cum laude from University of California, Los Angeles in 1976 with a B.S. degree in math and computer science. He continued his studies at University of California at Los Angeles School of Law, where he received his J.D. in 1979 and was elected to the Order of the Coif Honor Society.
