Part II, in the three-part series focusing on a commercial damages case, will explore next steps to begin reviewing information and developing a damages model, once the expert has met with counsel, considered relevant damage theories, and gathered documents. Attendees will learn:

  • How to develop a damage model consistent with plaintiff’s claims
  • How to test the model for reasonableness, including looking at revenues, costs, and any issues of mitigation
  • The factors to consider that may impact the court’s assessment of whether there is sufficient evidence to support a conclusion that the damages in question have met the reasonable certainty threshold
  • How to evaluate and determine an appropriate discount rate
