4 - Who is the Employer?

Description

The current “sharing economy” has ushered in a host of changes to the traditional employer/employee working relationship. This session will explore several facets of a contemporary service provider/service recipient relationship and how that pivots historical tax and benefit structures. Attendees will:
• Discuss employee/independent contractor designations, focusing on common law and practical applications of same by IRS and state authorities on audits
• Explore professional employer organizations’ (PEOs’) arrangements (vs. staffing agencies') and their nuances in benefit plan issues as well as employment tax issues
• Discuss controlled group implications for qualified plans where contractor populations are successfully challenged
• Discuss the implications for employers subject to the Affordable Care Act's Employer Shared Responsibility Rules for employee health care coverage
