Clients with less net worth than the current estate and gift tax exemptions have often not pursued estate planning thinking that planning does not apply to them. That could be a significant mistake. Asset protection, income tax benefits, succession, and other benefits remain. But of great concern is that if there is a Democratic victory in 2020 the Democratic proposals of a $1M gift exemption, $3.5M estate tax exemption, and restrictions on GRATs, discounts, GST planning and more, those clients will have missed out. What type of planning is suitable for clients in the $2-$22M net worth range? How can you use exemption, safeguard assets, permit access and accomplish planning goals for these clients? The presentation will explore the use of SLATs, DAPTs, hybrid DAPTs, SPATs, and variations.

The Auditing Standards Board (ASB) Chair and AICPA Chief Auditor will discuss recently issued standards for audits and attestation engagements. The discussion will also include the ASB’s active agendas including ongoing efforts to modernize auditing and attestation standards, enhance ASB outreach to stakeholders regarding proposed standards and post-implementation reviews of issued standards. This session will feature a discussion of the current status of the ASB’s projects to: a) Revise and expand the auditor’s report, b) Revise the attestation standards to enable a practitioner to perform an examination, review, or agreed-upon procedures engagement without having to request an assertion from the responsible party, c) Revise the audit evidence standard, d) Revise the standard on auditing management estimates and use of management specialists, e) Make narrow revisions to auditor communications regarding NOCLAR; and convergence efforts on auditor risk assessment, quality control and group audits.

All signs indicate that the prevalence of litigation is in a continuing upward spiral across the United States. Although some claims are meritorious, far too many are not. In such an atmosphere, any one with even a modicum of wealth is subject to an unacceptable level of risk. Aggravating this problem is the fact that even in those instances where liability might, unfortunately, be clear, the extent of the injury and, by extension, the dollar amount of the damages, often remains subjective and can therefore be grossly inflated by an overzealous judge or jury.

Timely and professional asset protection planning can help weather the storm of litigation and should be considered whenever you are called upon to advise a client in connection with their investment planning, tax planning, retirement planning, insurance planning or estate planning. This seminar will discuss ways in which your clients can protect themselves from potential future creditors, including (i) the ethics of asset protection planning, (ii) the law of fraudulent transfers, (iii) exemption planning, (iv) domestic and foreign asset protection trusts, and (v) integrating asset protection planning into your client’s estate planning.

  • Understand the law of fraudulent transfers, and when it is ethical, legal and perhaps even obligatory to advise clients concering asset protection planning.
